The petitioner seeks anticipatory bail in connection with Bhagalpur G. R. P. S. Case No. 218 of 2017, registered for offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code.
The allegation against the petitioner is of theft of mobile.
At the very outset it has been submitted by the learned counsel for the petitioner that he was already on bail on bond under the provisions of Section 41 (2) Cr.P.C. and once he has not misused the privilege of bail. It is further submitted that the stolen mobile has been recovered.
Patna High Court Cr.Misc. No.38427 of 2018 (2) dt.03-07-2018 2/2 Learned A.P.P. opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances discussed above, let the petitioner, above named, surrender before the Court below and make prayer for regular bail, which will be considered by the learned court below considering that earlier the petitioner was on police bond before the police, he has not misuse the same and will dispose of the prayer for bail, if possible on same day.
This application is accordingly disposed of on the same date.
