JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 07-04-2016 The District Magistrate cum Chairman of the District Compassionate Appointment Committee, Bettiah, must do a thorough analysis of the financial status of the family of the deceased employee as well the liability as such, which does not seem to be much, before any decision in favour of the petitioner can be taken for compassionate appointment.
Compassionate appointment is not meant for providing employment to otherwise unemployable or unemployed offspring of the government servant.
Patna High Court CWJC No.9811 of 2015 dt.07-04-2016 Petitioner is almost 40 years of age. Obviously, he has not achieved anything of significance in his life or else he would not be seeking employment under the State at such belated stage of life. The District Magistrate will also keep in mind the kind of pension and support which the government has extended to the family on the death of erstwhile employee, who was holder of a senior position in his life in police department.
Mere death of the bread-earner as a matter of course does not make a case for compassionate appointment as a routine. Such a decision be taken in the next meeting of the District Compassionate Appointment Committee and communicated to the petitioner.
