2. The petitioner seeks bail in connection with Pothia P.S. Case No. 372 of 2024 registered for the offence under Sections 103(1), 80(2), 61(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner is the husband of the deceased and he is said to have killed the deceased.

4. The petitioner is in custody since 7.12.2024.

5. Learned counsel for the petitioner submits that deceased has committed suicide and there are two children born out of the wedlock who are staying with the family of the petitioner.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Kishanganj/concerned Court below in connection with Pothia P.S. Case No. 372 of 2024.

8. As the petitioner claims that the children are staying with the family of the petitioner, the Court below will verify the same and will accept the bail bonds of the petitioner only if the children are staying with the family of the petitioner. (Sandeep Kumar, J) Vikas/- U
