2. The petitioner apprehends arrest in connection with Warsaliganj PS Case No.374 of 2025 dated 17.07.2025, instituted under Sections 319(2), 318(4), 338, 336(3), 340(2), 111(4), 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 55(B), 66(D) of the I.T. Act.
3. On a tip off that some cyber criminals have assembled at Devi Asthan Bagicha, in village- Jalalpur, and are duping people through their phones, the police raided the place and seized several mobile phones, however, some of the mobile phones were thrown in the garden and pond. Several accused persons fled away from the place of occurrence, but one person was caught by the police, who disclosed his name as Anupam

Learned counsel for the petitioner submits that only on the basis of disclosure made by co-accused, Anupam Kumar, who was apprehended at the spot, the petitioner has been implicated in this false and concocted case. The FIR has been lodged against fifteen persons including the petitioner. Nothing incriminating has been recovered either from the possession of the petitioner or from his house. Further submission is that similarly situated co-accused, Manish Kumar, has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 13.02.2026 passed in Cr. Misc. No.9609 of 2026. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in Warsaliganj PS Case No.374 of 2025, subject to the conditions laid down in Section
