The petitioner apprehends his arrest in connection with Mohania P.S. Case No. 438 of 2017, registered for the offences punishable under Sections 418, 419, 420 and 34 of the Indian Penal Code.

The police got information that one Arvind Kumar used to get over loaded truck passed through the checkpost. The police raided the place and intercepted three trucks.

Patna High Court Cr.Misc. No.56706 of 2017 (2) dt.14-12-2017 2/2 Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot. The name of the petitioner figured in the case on mere suspicion. He submits that similarly situated other accused persons have already been granted anticipatory bail.

Considering the facts and nature of the allegation made against the petitioner and the fact that many other accused persons, namely, Saroj Gupta, Chintu Singh, Mausam Khan and other similarly situated accused persons have been granted anticipatory bail, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohania P.S. Case No. 438 of 2017, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
