JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 Petitioner seeks bail in anticipation of her arrest in connection with Bihar P.S. Case No. 57 of 2019, registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the mother-in-law of the deceased, is of killing the deceased with respect to demand.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and she is mother-in-law and she is ready to abide by any condition that may be imposed on her.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda, in connection with Bihar P.S.Case No. 57 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that she has to cooperate in the investigation, otherwise prosecution is at liberty to move for cancellation of her bail bonds.
