2. The petitioner seeks regular bail in connection with Barh P.S. Case No. 814 of 2023 corresponding to Special (POCSO) Case No. 01 of 2024 registered for the offence punishable under Section-354B of the Indian Penal Code and under Section-8/12 of the POCSO Act.

3. Allegedly, the petitioner after luring and giving Bhunja, took informant's minor daughter to a lonely place and outraged her modesty.

4. Annexing depositions of the informant and her minor daughter by filing supplementary affidavit, learned counsel for the petitioner has submitted that during trial, the

Patna High Court CR. MISC. No.51482 of 2024(3) dt.23-09-2024 2/2 informant and the victim did not support the prosecution case. The petitioner is in custody since 23-12-2023.

5. Learned counsel appearing for the State has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction Special (POCSO) Case No. 01 of 2024 of learned Additional Sessions Judge-VI-cumSpecial Judge (POCSO), Patna, in connection with Barh P.S. Case No. 814 of 2023 corresponding to Special (POCSO) Case No. 01 of 2024 subject to the condition that the petitioner will appear in the court below on each and every date fixed in the case and if, he fails to do so on two consecutive dates unless he is prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
