JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-07-2019 This is an application for grant of anticipatory bail in connection with Tajpur P.S. Case No. 342 of 2018, disclosing offences under Sections 302/34, 120B of IPC and Section 27 of the Arms Act.

Petitioner is not named in the F.I.R. Allegation of murder of husband of the informant and only suspicion is raised against the petitioner and some other accused persons. It further appears that during the investigation, name of the petitioner transpires in the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that he is a businessman and he has falsely been implicated in this case. Except confessional statement there is nothing against the petitioner.

Heard learned A.P.P. also, who opposed the prayer for

Patna High Court CR. MISC. No.27722 of 2019(5) dt.29-07-2019 2/2 anticipatory bail on the ground that apart from the confessional statement, CDR details disclosed that he was in constant touch with the other accused persons and his mobile location was also found near the place of occurrence.

Having heard both sides, considering the above stated facts, I am not inclined to grant privilege of anticipatory bail to the petitioner. He may surrender before the learned court below and make prayer for regular bail, without being prejudiced by order of this Court.
