JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-03-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code and 27 of the Arms Act.

Prosecution's case, in brief, is that the petitioner and co-accused Prince Singh, Manoj Mukhia, Suman Singh and four unknown persons assaulted the nephew of the informant and when the informant tried to protect him, co-accused Manoj Singh and Prince Singh made firing which hit the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Allegation of firing is against co-accused persons. In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in Banka Rajoun Police Station Case No. 383 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
