JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Barabar Prayatan P.S. Case No. 31 of 2016 for an offence under sections 323, 341, 307 and 504/34 of the Indian Penal Code. Counsel for the petitioner submits that from perusal of the FIR, it would be apparent that the allegation of assault on the head of the informant is against the father of this petitioner. The allegation against this petitioner is that he has assaulted with lathi but there is no allegation that he has assaulted on the vital part of the informant or any other persons. Counsel for the petitioners submits that petitioner has clean antecedent and admittedly petitioner and informant are 'Gotias' and there is long pending land dispute. Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.53688 of 2017 (2) dt.10-11-2017 2/2 let the petitioner, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Jehanabad, in connection with Barabar Paryatak P.S. Case No. 31 of 2016, subject to the condition as laid down under section 438(2) of the Cr.P.C.
