JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks quashing of the order dated 24.09.2013 passed by the Special Officer, Rationing, Patna, by which his P.D.S. license has been cancelled.

The petitioner submits that he has been prejudiced from filing effective show-cause reply, as the copy of the enquiry report was not served on him. He submits that the copy of the enquiry report revealed the names of 27 consumers, who made allegations against him.

A counter affidavit has been filed on behalf of the State annexing the copy of the detailed enquiry report. Learned counsel for the State submits that there are grave and serious allegations against the petitioner of violating the terms and conditions of the license.

The petitioner would file a detailed show-cause reply within four weeks from today before the enquiry officer, who would proceed to examine the same in accordance with law. The impugned order passed by the Special Officer, Rationing, Patna would remain in abeyance.

As the petitioner succeeds on technical points, there would be no resumption in supply of trade articles. This application stands disposed of.
