The petitioner seeks pre-arrest bail in connection with Islampur P.S.Case No.199 of 2017 registered under Sections 447, 341, 323, 504, 308 and 379/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there is case and counter case in respect of the alleged incident. The case filed against the informant and others was numbered as Islampur P.S. Case No.200 of 2017. He submitted that the accused persons are co-villagers and the dispute arose due to site of installation of hand pump. The injuries sustained are all simple and superfluous and the ingredients of the offence
Patna High Court Cr.Misc. No.61231 of 2017 (2) dt.22-12-2017 2/2 punishable under Section 308 of the I.P.C. are attracted. Learned counsel for the State opposed the prayer for grant of pre-arrest bail to the petitioner.
Considering the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Hilsa, Nalanda in connection with Islampur P.S.Case No.199 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
