JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Chandauti P.S. Case No. 136 of 2014, registered for offences punishable under Sections 341, 323, 387, 307/34 of the Indian Penal Code and Section 27 of Arms Act.

Allegation against the petitioner and other co-accused is of assault with the butt of riffle to the informant and also allegation of demanding extortion from the informant. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case due to politics and injuries are simple in nature, except one injury. It is also submitted that the final form has been submitted against the petitioner and later on cognizance has been taken by the learned

Patna High Court Cr.Misc. No.40308 of 2018 (2) dt.11-07-2018 2/2 Magistrate and the similarly situated co-accused has been granted privilege of anticipatory bail vide order dated 12.01.2015 passed in Cr. Misc. No. 1042 of 2015.

Learned A.P.P. opposes the prayer for.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders before the court below within a period of six weeks from the date of the order, he will be released on provisional bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Dinker Kumar, learned Judicial Magistrate, 1st Class, Gaya, in connection with Chandauti P.S. Case No. 136 of 2014, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
