Petitioner apprehends his arrest in connection with Trial No. 3803 of 2017, arising out of Nautan (Jagdishpur) P.S.Case No. 332 of 2016 registered for the offences punishable under Sections 420, 406, 467, 468 and 471/34 of the Indian Penal Code. Allegation against the petitioner is that he has taken paddy from the informant worth Rs.16 lakhs and he has returned only Rs.2 lakhs and rest amount has not been returned. Submission of learned counsel for the petitioner is that for the same offence two cases have been lodged and in the present case final form has been submitted by police as mistaken of facts and in the second case he has been granted privilege of
Patna High Court Cr.Misc. No.39893 of 2018 (2) dt.10-07-2018 2/2 anticipatory bail.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI-cum-Sub-Judge-III, West Champaran, Bettiah, in connection with Trial No. 3803 of 2017, arising out of Nautan (Jagdishpur) P.S.Case No. 332 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
