JUSTICE MADHURESH PRASAD ORAL ORDER 06-09-2022 The petitioner's contractual services as Panchayat Rojzar Sevak has been brought to an end by order dated 20.01.2018 issued by the Deputy Development Commissionercum-Additional District Programme Coordinator, Khagaria (DDC for short). The petitioner's appeal against the said order has also been dismissed by the District Magistrate, Khagaria, under order dated 31.12.2018. The petitioner, by way of the instant writ petition, seeks quashing of the two orders dated 20.01.2018, by the DDC, as well as 31.12.2018, by the District Magistrate, Khagaria.

The brief factual background is that an FIR was

2/4 instituted as per direction of the Block Development Officer, Gogari (BDO for short). The same gave rise to Maheshkhunt P.S. Case No. 171 of 2017 for alleged offences under Sections 420, 409 and 468 IPC wherein the petitioner along with eight ward members have been made accused. The criminal case is based on allegation regarding financial irregularity by the petitioner along with the ward members. It is alleged that by affixing photograph of various beneficiaries on photograph of one toilet, bills have been submitted. Thus the bills have been submitted for beneficiaries under the Lohiya Swachta Scheme for construction of toilets for various beneficiaries, though only one toilet was constructed. The same allegations let to issuance of a show cause dated 12.12.2017 to the petitioner.

The petitioner has responded to the show cause notice denying the petitioner's role in the alleged misappropriation of funds under the Lohiya Swachta Abhiyan. After due consideration of the petitioner's stand the same has been found unsatisfactory and petitioner's contractual services brought to an end. The actions has been taken under Clause 3 and 4 of the contract executed by the petitioner with the District Rural Development Authority. The Court finds no reason to interfere with the same, since in his response to show cause notice dated 12.12.

3/4 well as in his appeal filed before the District Magistrate petitioner has admitted to his role, in so many words, which reads as follows:- "मुझ ललाभमुककों कझ आवझदन पत्र जजिसपर ललाभमुक एव उनकझ शशौचलालय कला फफोटफो जचपकला थला- कक भशौजतिक जिजाँच हझतिमु मुझ जदयला गयला थला एव मझरझ दलारला ललाभमुककों कझ शशौचलालय कक भशौजतिक जिजाँच कक गई थक तिथला मझरझ दलारला भशौजतिक सत्यलापन में पलायझ गयझ सहक जसथजति ललाभमुककों कझ नलाम कझ सलामनझ दशर्शातिझ हमुए जिजाँच प्रजतिवझदन प्रखण्ड कलायर्शालय कफो समजपर्पिति जकयला गयला थला।"

It is under such circumstance that the District Magisrate, after due consideration of this plea raised by the petitioner, has arrived at a conclusion, which reads as follows:- "शक दकपक कमुमलार अनमुबवध रद्द पवचलायति रफोजिगलार सझवक नझ अपनझ अपकल अभ्यलावझदन भक में सवककलार जकयला ह जक उन्हमें ललाभमुककों कझ आवझदन पत्र जजिस पर ललाभमुककों एव उनकझ शशौचलालय कला फफोटफो जचपकला कर भशौजतिक जिजांच हझतिमु उन्हमें जदयला गयला थला और उनकझ दलारला भशौजतिक रूप सझ जिजांच जकयला गयला। जकन्तिमु शशौचलालय पर ललाभमुक कला Photo-Cut-Paste जकयला गयला ह इसकला प्रजतिवझदन उनकझ दलारला नहहीं जदयला गयला ह। शक कमुमलार कला यह कथन सवककलार यफोग्य नहहीं ह।

4/4 क्यकोंजक उन्हमें अपनला प्रजतिवझदन अवजकति करनझ कझ पूवर्पि आवझदन पर अवजकति फफोटफो सझ आवझदक एव शशौचलालय कला भक जमललान जकयला जिलानला थला। जकन्तिमु उन्हकोंनझ ऐसला नहहीं जकयला। ऐसक जसथजति में शक दकपक कमुमलार कला अपकलकय अभ्यलावझदन असवकककति जकयला जिलातिला ह।"

The said conclusion is based on a consideration of the petitioner's reply to show cause, by reasoned and speaking orders. It is also an admitted position that the petitioner is a contractual employee.

This Court, therefore, would observe that the impugned orders require no interference of this Court exercising jurisdiction under Article 226.
