JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioner seeks regular bail in connection with Special Case No. 94 of 2019 (CIS No.94 of 2019) arising out of Bahadurganj P.S. Case No.76 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Allegation as per F.I.R. is of recovery of 58.8 liters of foreign liquor was recovered and the co-accused Subham Jha was arrested from the spot, who disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession and he is in custody since 17.03.2019 and the charge sheet has been submitted in this case, as such there is no chance of tampering with the evidence and the petitioner has no criminal

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Kishanganj, in connection with Special Case No. 94 of 2019 arising out of Bahadurganj, P.S. Case No.76 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
