JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 04-09-2023 Heard Mr. Niranjan Parihar, learned counsel appearing on behalf of the petitioner, Mr. Syed Hussain Majeed, learned counsel appearing on behalf of the State, Mr. Ranjeet Kumar Pandey, learned counsel appearing on behalf of the Patna Municipal Corporation and Mr. Binod Kumar Labh, learned counsel appearing on behalf of the Accountant General.
2. Learned counsel appearing on behalf of the petitioner submits that petitioner is legally wedded wife of deceased employee namely Late Dev Lal Paswan, who had retired from the post of Peon form the office of Water Board of Patna Municipal
Patna High Court CWJC No.9514 of 2023 dt.04-09-2023 2/2 Corporation. The husband of the petitioner had died on 10.04.2020. He further submits that the petitioner is legally wedded wife of the deceased employee and till date no one of the family members have objected the entitlement of the petitioner to receive family pension.

Considering the relief as sought for in the present writ petition, the petitioner if so advised, she may file detail representation before the Municipal Commissioner, Patna, who will call for service records of deceased employee namely Dev Lal Paswan from the Water Board of the Municipal Corporation situated in Patna and redress the grievance of the petitioner within a period of four weeks.
4. In case the petitioner is entitled for family pension, the same be given to her within a period of four weeks along with statutory interest in accordance with law.
5. With the above observation and direction the writ petition stands disposed of.
