2. The petitioners apprehend their arrest in connection with Bibhutipur P.S. Case No. 321 of 2023 registered under Sections 147, 148, 149, 323, 341, 325, 379, 307, 504 and 506 of the Indian Penal Code.
3. On the alleged date and time of occurrence, all the F.I.R. named accused persons including these petitioners armed with weapons came to the land of the informant and started
Patna High Court CR. MISC. No.34021 of 2024(2) dt.23-05-2024 2/3 abusing the informant and his family members. On protest, all the accused persons including these petitioners assaulted the informant and his family members due to which, they sustained injuries.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to local village politics. Further submission is that as a matter of fact, there is land dispute between the parties and it was the informant and his family members who were aggressors and assaulted the petitioners and his family members with deadly weapons causing serious injuries for which Bibhutipur P.S. Case No. 318 of 2023 was lodged by petitioner no. 2 against the informant and others and the present case is merely a counter blast of the same. It is next submitted that the injuries allegedly caused by these petitioners are simple in nature.
5. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional
