JUSTICE MADHURESH PRASAD ORAL ORDER 21-08-2019 It is submitted by Counsel for the petitioner that the petitioner is entitled to be paid his dues after adjustment of the advances paid to him for execution of work under Manrega scheme.

He submits that Annexure 12 is a report dated 23.9.2013 showing details of work executed. It is the prayer of the petitioner that in light of Annexure 12 submitted on the basis of joint assessment by the Executive Engineer and Assistant Engineer the authorities should take a decision in respect of the amount admissible to the petitioner. In view of such submission and since respondent No. 5 is required to consider petitioner's claim in light of the joint report dated 23.9.2013, no adjudication is required in the instant proceeding and pendency of the same would be futile. The writ application is disposed of with a direction to respondent No. 5 to take a final decision on the petitioner's claim in light of the joint report dated 23.9.2013, if the same has not been done till date, by a reasoned and speaking order within a period of three months from the date of receipt/production of a copy of this order.

The writ application stands disposed of.
