The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 386, 387 of the Indian Penal Code.

It is a case of demand of 25 lakhs ransom money by way of mobile phone, after that this case has been lodged. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. The petitioner is not named in the FIR and his name has been transpired in this case on the basis of confessional statement of co-accused Himanshu Jha @ Jokhan Jha, which has no evidentiary value in the eye of law. The mobile from which the call has been made, is not concern with the petitioner rather it is issued on the name of co-accused namely, Abhishek Raj. It is further submitted that demand of ransom money has not been executed. Similarly situated other accused namely Vivek Kumar has already been enlarged on bail by this Bench vide order dated 01.05.2023 passed in Cr. Misc. No.5701 of 2023. The petitioner is languishing in judicial custody since 24.12.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bairgania P.S. Case No. 57 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate I/c, Sitamarhi.
