JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-10-2024 Though the present writ petition has been filed for quashing the order dated 09.07.2014, passed by the District Judge, Patna in Civil Misc. (Transfer) Case No.142 of 2014 whereby and whereunder the learned Court below has been pleased to transfer the pending Title Partition Suit No.336 of 2010 to the learned Court of Additional District & Sessions Judge, Danapur as also has directed that the same be heard along with Title Suit No.24 of 2012, however, the learned Court of Additional District & Sessions Judge-II, Civil Court, Danapur, vide letter dated 06.08.2018, has informed this Court

Patna High Court CWJC No.19410 of 2014(4) dt.03-10-2024 2/2 that the Plaintiff has led his evidence and the Plaintiff's evidence has been closed on 08.01.2018, whereafter the defendant is adducing evidence.

2. In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to pursue the aforesaid cases before the learned trial court, itself. Liberty so sought is granted.

3. Accordingly, the present writ petition stands disposed off as not pressed.
