The petitioners seek bail in connection with Guthani P.S. Case No.4 of 2019 registered under Sections 395 and 397 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that the case was registered against unknown accused persons. In course of investigation, the petitioners were arrested merely on the basis of confessional statement of co-accused. The petitioner nos. 1 and 2 were remanded to judicial custody on 06.01.2019 and petitioner no. 3 was remanded to judicial custody on 25.01.2019. Till date, they have not been put on test

Patna High Court CR. MISC. No.29732 of 2019(2) dt.22-05-2019 2/3 identification parade. There is also no recovery either from their personal possession or from their respective houses of any incriminating articles.

Learned counsel for the State has opposed the application for grant of bail to the petitioners. Considering the submissions made above as also the statement made in para 3 of the application that the petitioners have got no criminal antecedent, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Guthani P.S. Case No.4 of 2019 subject to the following conditions:- (a) that the petitioners shall attend court in accordance with the conditions of the bond executed;

(b) that the petitioners shall not commit an offence similar to the offence of the present case; and (c) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court
