JUSTICE SANJAY PRIYA ORAL ORDER 3/ 22-12-2017 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner apprehends his arrest in Turkauliya P.S. Case No.550 of 2017 instituted for the offence under Section(s) 341, 323, 324, 307, 379/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Motihari. As per written report, there is specific allegation against this petitioner of assaulting the informant with farsa on his head.

It is mentioned in para 18 of the case diary that injured was admitted in the hospital, but he left hospital in the midst of treatment.

Patna High Court Cr.Misc. No.54373 of 2017 (3) dt.22-12-2017 2/2 Injury report is mentioned in para 26 of the case diary, which is of private clinic. Doctor has found grievous injury on the person of the injured.

Counsel for the petitioner has mentioned in para 3 that the petitioner has no criminal antecedents, but it is mentioned in para 59 of the case diary that the petitioner has criminal antecedents.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
