This application for grant of regular bail arises out of Excise Case No. 149 of 2020, disclosing offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioners are in custody since 05.07.2020. Their prayer for regular bail was earlier rejected by an order dated 23.12.2020 passed in Cr. Misc. No. 34144 of 2020. Allegedly, 531 liters of illicit liquor was recovered by the police from a car occupied by these petitioners during the course of checking being conducted by the police.

Mr. Sandeep Kumar, learned Senior Counsel

Patna High Court CR. MISC. No.39318 of 2021(2) dt.11-08-2021 2/2 appearing on behalf of the petitioners has submitted that the petitioners have remained in custody for more than a year and the allegation against them is of recovery of 531 liters of illicit liquor. He submits that the petitioners shall present themselves before the Court as and when required for the purpose of trial. Considering the above submission and the petitioners incarceration, this application is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II-cum-Special Judge, Excise, Gopalganj, in Excise Case No. 149 of 2020.
