====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 26-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners are apprehending their arrest in connection with Karpi P.S. Case No. 273 of 2024 registered for the offences punishable under Section 192, 190, 115(2), 109, 132, 134, 351(2) of B.N.S. Act.
3. As per prosecution case, the informant was deployed at Middle School, Khajuri, for duty during the PACS election. In the meantime, two persons came to the election booth, out of whom, one person was smoking and the other was having identity card of press. The informant asked him to smoke outside the election booth. After some time, both persons
Patna High Court CR. MISC. No.34067 of 2025(2) dt.26-05-2025 2/3 returned with a group of 40-50 persons and assaulted the informant and the petitioners were among them.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Petitioner No. 1 bears three criminal antecedent and out of three cases he is acquitted in two cases and in one case he is on bail. Petitioner No. 2 bears one criminal antecedent and it is orally submitted that he is on bail in that case. Learned counsel further submits that there is no specific allegation against the petitioners. Allegations against the petitioners are general and omnibus in nature. Learned counsel orally submits that from perusal of the FIR, it is not clear as to who has divulged the name of the petitioners, and hence, the authenticity of the F.I.R. is doubtful.
There were many persons available at the place of occurrence and because of village politics names of the petitioners are surfaced in the present case. Learned counsel further submits that co-accused Abhishek Ranjan has been granted anticipatory bail vide Cr. Misc. No. 32147 of 2025 by a co-ordinate bench of this Court and the case of present petitioners is similar and identical in nature, therefore, petitioners also deserve anticipatory bail.
5. The learned A.P.P. for the State opposes the prayer
Patna High Court CR. MISC. No.34067 of 2025(2) dt.26-05-2025 3/3 for anticipatory bail of the petitioners.
6. Considering the facts and circumstances of the case, co-accused persons have already been granted bail by this Court, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Karpi P.S. Case No. 273 of 2024, subject to the conditions as laid down under Section 482 (2)of BNSS.
7. The application stands allowed.
