Mr. Addl Public Prosecutor ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State through Video conferencing.

Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner no.1 gave farsa blow causing head injury to the informant while petitioner no.2 is order giver and no.3 snatched wrist watch and three thousand rupees from informant.

Learned counsel appearing for the petitioners submits that there is a case and counter case and out of three injuries

Patna High Court CR. MISC. No.29194 of 2020(2) dt.04-12-2020 2/2 sustained by the informant, only injury no.3 has been found to be grievous in nature. Both parties are agnate. Considering the facts of the case, prayer for bail of petitioner nos. 2 and 3 is allowed. In the event of arrest/surrender, let the petitioners no. 2 and 3, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Waris Nagar Police Station Case No. 43 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.

However, prayer for bail of petitioner no.1 is refused since he is alleged to have caused grievous injury to informant, with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) Shashi U T
