The petitioner apprehends his arrest in Birpur P.S. Case No. 219 of 2016, instituted for the offence punishable under Section 379 of the Indian Penal Code.

The informant has alleged in the F.I.R. that the petitioner was staff of "Test House" Company at the relevant time and was deputed in Mundeshwari Construction Company as Lab Technician by the "Test House" Company. The informant further alleged that the petitioner had stolen various articles along with other valuable documents from the Godrej Almirah of the office. Learned counsel for the petitioner has submitted that there is no any recovery from possession of the petitioner. It is further submitted that only vague allegation has been levelled

Patna High Court Cr.Misc. No.46493 of 2018 (2) dt.23-08-2018 2/2 against the petitioner because he had left the job of the said "Test House" Company of the informant.

Considering the facts and circumstances of the case, the prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Birpur P.S. Case No. 219 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Birpur, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
