2. A counter affidavit filed by the State is taken on record.

3. The Chief Medical Officer-cum-Civil Surgeon, Sadar Hospital, Purnea has appeared personally and has informed this Court that the possession of the premises in question has been given to the petitioner.

4. This Court has earlier also noticed that when a

Patna High Court CR. WJC No.867 of 2024(3) dt.01-07-2025 2/2 crime is alleged to be committed by a tenant the premises of the landlord is being kept under lock for years to come, this should not be done. If a crime is committed by a tenant, the police is not required to lock the premises of the landlord, they can remove the machinery etc. and keep it in the Police Station, but they are not required to seal the premises.
