The petitioner apprehends his arrest in connection with Complaint Case No. 467 of 2016, registered under Sections 406, 420, 506, 323, 467 and 468 of the Indian Penal Code. The accusation is that petitioner took cash of Rs. One lakh to the complainant on the pretext to provide job to him. Later on petitioner also took Rs. 21000/- for preparation of demand draft and cheque of Rs. 75000/-. Thereafter, appointment letter was handed over by the petitioner to the complainant on 13.06.2013, which was found forge. On several requests, the petitioner did not return the money. Learned counsel for the petitioner submits that, in fact, the petitioner who used to run coaching had taken loan of Rs. 75,000/-

Patna High Court Cr.Misc. No.54475 of 2017 (2) dt.15-11-2017 2/2 to the complainant out of which he deposited Rs. 45,000/- in the account of complainant and remaining amount of Rs. 30,000/- is still to pay by the petitioner to the complainant. Only to give pressure, the complainant has lodged the present case.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Compliant Case No. 467 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
