JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and the State. The petitioner has questioned the order dated 13.08.2013, passed by the Sub-Divisional Officer, Sadar, Gaya cancelling Kerosene Oil, Rickshaw vender license under Bihar Trade Articles ( Licences Unification) Order, 1984. The license has been cancelled on the ground that license has been issued in the name of Ram Naresh Prasad, son of late Ram Das Singh, whereas the name of the licensee is Ram Naresh Singh, son of Parmeshwar Singh, The petitioner submits that by mistake while making the application for grant of license, the name of his father was wrongly typed as Ram Das Singh in place of Parmeshwar Singh,

Patna High Court CWJC No.18148 of 2013 (3) dt.30-09-2015 2 / 2 which some how or the other could not get corrected. A counter affidavit has been filed on behalf of respondent nos. 2 to 4. In para. 7 of the counter affidavit, it is stated that petitioner knowingly and deliberately inserted his father name for illegal gain.

In the facts and circumstances of the case, I grant one more opportunity to the petitioner to explain his case before the licensing authority that the mistake was bonafide and he had nothing to gain by giving a false name of his father. With the aforesaid observation, this application stands disposed of.
