JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 30-09-2015 The petitioner prays for quashing the order dated 19.7.2013, passed by respondent no.2 by which he confirmed order dated 30.8.2011, passed by respondent no.3 cancelling his PDS licence on the ground of irregularities committed by him in running the shop.

In paragraph 9 of the writ petition, the petitioner submits that his shop was never inspected by the respondents on the relevant time and the enquiry report dated 7.8.2011 is not portraying the true picture of his shop. Further, his shop lies in village Bharub under Bharub Panchayat of Obra block under Daudnagar sub division of Aurangabad district, which was inspected time to time by respondent no.4 and no irregularities were found which would also be apparent from the stock register.

Patna High Court CWJC No.20685 of 2013 (2) dt.03-10-2015 2/2 In view of the petitioner's submission, the impugned orders are kept in abeyance and the petitioner is given liberty to satisfy respondent no.3 that his shop was not inspected on the relevant day and time and the allegations are false and that he distributed entire supplied grains to the card holders. Respondent no.3 would pass order within four months from the date of receipt of the representation by the petitioner. Shashi.
