JUSTICE MIHIR KUMAR JHA ORAL ORDER 20-08-2015 This case has been brought under the heading „to be mentioned‟ at the instance of the learned counsel for the petitioner, who submits that the petitioner is actually an Assistant Teacher in secondary school and as such, the remedy for him in relation to grievance of his transfer will be covered by Seva Sarta Niyamawali, 1983 in which the power has been vested to the Director, Secondary Education to take a final decision. That being so, the second paragraph of the order dated 20.7.2015 in this case shall be read as follows: " Having regard to the fact that the petitioner, an Assistant Teacher in Secondary School, is aggrieved by an order of transfer, the remedy for him is only by way of filing an appeal in terms of Seva Sarta Niyamawali, 1983."
