Heard learned counsel for the petitioner as well as learned Addl.P.P. for the State.

The present application has been filed for restoration of Cr. App. (SJ) No. 2581 of 2019 to its original position, which was dismissed for default.

For the reasons disclosed in the restoration application it is allowed, and Cr. App. (SJ). No. 2581 of 2019 is restored to its original file and number subject to deposit of Rs. 3,000/- to the Victim Compensation Fund.

The petitioner is directed to remove the defects as observed by this Court in Cr. App (SJ) No. 2581 of 2019 vide order

Patna High Court CR. MISC. No.34735 of 2022(2) dt.13-07-2022 2/2 dated 02.09.2019 within one week, failing which, instant memo of appeal will be dismissed without further reference to the Bench. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
