The petitioner apprehends his arrest in Jehanabad P.S. Case No. 310/2018, registered for the offences punishable under Section 420 of the Indian Penal Code and section 63 of Copy Right Act.
The informant raided the shop and alleged that petitioner was selling duplicate books of the publication of the informant. The petitioner was found sitting on the shop of his son namely, Bhola Kumar.
Learned counsel for the petitioner submits that in the absence of his son, the petitioner was sitting on the shop. He did not know about the duplicacy of the book. The police arrested the
Patna High Court Cr.Misc. No.34453 of 2018 (2) dt.02-07-2018 2/2 petitioner for the offence under Section 63 of Copy Right Act which is bailable, but later on, the police inserted Section 420 of the Indian Penal Code.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 310/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J) Vinita/- U T
