JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 31-01-2018 Heard the learned counsel for the petitioners and learned APP for the State.

In this application, the petitioners apprehend their arrest for the offences in connection with Hilsa P.S. Case No. 512 of 2017 punishable under Sections 147, 149, 323, 504, 307, 379 of the Indian Penal Code.

In the F.I.R., the petitioners are named as member of the mob, having no specific allegation for committing any overt act. The specific allegation is against Putus Raut and Bijendra Mahto.

Submission is of false implication and that in this

No.63120 of 2017 (2) dt.31-01-2018 2/2 case Putus Raut and Bijendra Mahto have been allowed pre-arrest bail vide ABP No. 862 of 2017/2778 of 2017 and against the petitioners there is no allegation for committing any overt act and, as such, they also deserve sympathetic consideration to which the learned APP does not oppose.

Considering the facts and circumstances as stated above, the petitioners, in case of their surrender or arrest within four weeks from the date of receipt/production of a copy of this order shall be enlarged on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Learned Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Hilsa P.S. Case No. 512 of 2017 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
