The petitioner seeks bail in connection with Shahkund P.S. Case No.228/2023, registered for the offence punishable u/s 302, 120-B/34 of the IPC.

Allegation against the petitioner is that he along with other co-accused persons killed the informant's daughter. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No such occurrence in the manner as alleged, has ever taken place. He has been falsely implicated in this case due to ulterior motive. He is the younger brother-inlaw of the deceased and there is general and omnibus allegation against him. He was not present in the village on the alleged

Patna High Court CR. MISC. No.33309 of 2024(3) dt.12-07-2024 2/2 date of occurrence, rather he was in Ludhiyana (Punjab) for his duty. The petitioner has one criminal antecedent and has been languishing in custody since 12.03.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, since there is no specific overt act against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Shahkund P.S. Case No.228/2023.
