1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Shikarpur P.S. Case no.169 of 2025, registered under sections 126(2), 115(2), 75, 78, 318(4), 303(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023, section 8 of the POCSO Act and section 66E of the I.T Act.
3. As per the prosecution case, the informant states that while she was studying in Class-9, Krishna Kumar Gupta
Patna High Court CR. MISC. No.32632 of 2025(4) dt.10-09-2025 2/3 took her to his place on the pretext of talking about marriage. After having food there, she lost consciousness. Subsequently, the said Krishna Kumar Gupta showed her some objectionable photographs of her as also video and started to threaten her. It is stated that under threat and coercion, he extorted various amounts from her to the tune of Rs. 6 lacs and 1.75 lacs from the ATM. He threatened that in case the informant did not listen to him, he would make the photographs/video viral. On the members of the informant's family going to talk to the family members of Krishna Kumar Gupta, it is stated that they started to abuse and threatened to assault them. It is stated that besides Krishna Kumar Gupta, other accused persons including the petitioner nos. 1 and 2 have also extorted money from them.
4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. The allegations, if any, are mainly against Krishna Kumar Gupta and not the petitioners herein. The said Krishna Kumar Gupta who is himself a juvenile surrendered in the learned Court below and was subsequently released on bail. It is further submitted that so far as the informant is concerned, on one hand she claims herself to be a minor, on the other hand a bank account cannot be opened in the name of a minor. 5. The application for anticipatory bail is opposed by learned A.P.P for the State.
6. On perusal of the material on record, it transpires in the statement under section 183 of BNS that the victim has stated that on going to meet the family of Krishna Kumar Gupta ie the petitioners herein, all of them gave her food, after eating of which she became unconscious. It subsequently transpired that objectionable photographs and videos of her have been taken/made which were used by the accused persons to extort money from her.
7. In the facts of the case, the Court is not inclined to enlarge the petitioners on anticipatory bail and the application is rejected.
8. The petitioners are directed to surrender in the learned Court below within a period of four weeks. (Partha Sarthy, J) Shiv/- U T
