JUSTICE SANJAY PRIYA ORAL ORDER 01-12-2017 Heard learned counsel for the petitioner and leaned Additional Public Prosecutor of the State.
The petitioner is apprehending his arrest in connection with Banka P.S.Case No. 182 of 2006 registered for offences punishable under Sections 366A & 120 B of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
Learned counsel for the petitioner submits that the victim girl has already married with the petitioner and they are living as wife and husband and two children have born from their wedlock.
The learned Sessions Judge has mentioned in the impugned order that process under Section 82 Cr. P. C. has already been issued against petitioner.
Patna High Court Cr.Misc. No.56793 of 2017 (2) dt.01-12-2017 2/2 In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for grant of anticipatory bail of the petitioner is rejected. The petitioner is directed to surrender along with the victim girl before the Court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail which shall be considered and disposed off by the Court below in accordance with law after taking into consideration that both have married without being prejudiced by this order on the same day.
