2.The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201 and 34 of the Indian Penal Code.

3. As per prosecution case, the dead body of the mother of the informant was recovered near the boundary wall of the newly constructed house of one Meghnath Prasad. The informant reported that his family members had old enmity with the family of this petitioner, who has been absconding from house after the alleged occurrence and the informant

Patna High Court CR. MISC. No.30438 of 2023(4) dt.29-08-2023 2/3 alleged that petitioner along with other unknown persons committed murder of his mother.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity between both the parties. It is further submitted that Neither any consistent material has come against the petitioner nor any eye witness of the alleged occurrence, only on the basis of suspicion, petitioner has been dragged in this case. Similarly situated other co-accused person has already been granted bail by the different co-ordinate Bench of this Court vide Annexure-3 of this petition. Moreover, the petitioner is languishing in judicial custody since 10.02.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Didarganj P.S. Case No. 220 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
