2. The petitioner is apprehending arrest in connection with Shikarpur P.S. Case No. 169 of 2025, dated 09.02.2025, lodged under Sections 126(2), 115(2), 75, 78, 318(4), 303(2), 352 and 351(2) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023"), pending before the Court of District & Addl. Sessions JudgeVII- cum- Special Judge (POCSO), West Champaran, Bettiah.

3. As per the prosecution, FIR has been lodged against four named accused persons, including the present

The specific allegation against the petitioner is that he entered into friendship with the informant on Instagram and subsequently invited her and offered her food, after which she became unconscious. It is alleged that the petitioner then took obscene photographs of her and began blackmailing her. Under pressure, the informant was allegedly forced to pay several lakhs of rupees to prevent the photographs from being made viral. However, the photographs eventually went viral, and when the informant disclosed the incident to her family members then the present case was filed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the petitioner and the victim were in a relationship, but after the petitioner's family rejected the proposal for marriage, the present case was lodged as part of a conspiracy. Counsel also submits that the petitioner has a clean criminal antecedent and is ready and willing to comply with any conditions whatsoever that may be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the petitioner has committed a heinous offence.

6. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
