JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 498A, 354A of the Indian Penal Code.

Allegation is that the petitioner assaulted the victim by means of knife, due to which she sustained injuries. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Due to petty reasons the alleged occurrence

Patna High Court CR. MISC. No.27707 of 2019(3) dt.16-05-2019 2/2 had taken place. The petitioner had no intention to cause injury upon the victim. Except for offence under Section 307 of I.P.C., other offences are triable by the Magistrate. It is further submitted that the petitioner may be released after completion of six months in custody since 07.12.2018.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of six months in custody since 07.12.2018 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. case No.439 of 2018.
