The petitioner seeks bail in connection with Sessions Trial No. 115 of 2018 arising out of Nawada Nagar P.S. Case No. 704 of 2017 dated 19.10.2017 registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner had been enlarged on regular bail vide order dated 26.04.2018 by co-ordinate Bench of this Court in Cr. Misc. No. 18468 of 2018 and he had submitted bail bond on 02.05.2018 and was released. The petitioner went to Surat for earning his

No.30542 of 2023(2) dt.13-06-2023 2/3 livelihood and he had no knowledge about the cancellation of his bail bond and subsequent proceedings due to which he does not appear before the learned Court below and when he came to know the same, he has himself surrendered before the Court concerned on 05.12.2022 and he is in jail custody since then. Charge has already been framed in this case. He further submits that the petitioner is ready to abide by the terms and conditions laid down by this Court and will co-operate in the completion of the trial in the learned Court below.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Nawada in connection with Nawada Nagar P.S. Case No. 704 of 2017, subject to the following conditions:- (i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court.
