Having regard to the fact that the petitioner has a grievance as with regard to his transfer order issued by the Block Development Officer, Motihari Sadar dated 04.06.2015, and the admitted position that the petitioner is a Panchayat Secretary, the remedy for him in the first instance would be before the Collector of the district, who is the controlling authority.

That being so, the petitioner may represent his case before the Collector of the district as with regard to the impugned order of transfer and it is expected that if

Patna High Court CWJC No.9552 of 2015 (2) dt.20-07-2015 the petitioner files such representation before the Collector of the district, the same shall be looked into and decided by the Collector of the district in accordance with law preferably within a period of three months from the date of receipt of this order. It is, however, also made clear that the petitioner in the meantime must comply the transfer order, if he has not done so.

With the aforementioned observation and direction, this application is disposed of.
