The petitioner seeks bail in Islampur P.S. Case No. 385 of 2018, instituted for the offence under Section(s) 414 of the Indian Penal Code.

It is alleged in the written report that while informant was on duty received information that Manish Kumar @ Monu Kumar have a stolen passion pro Motorcycle. The informant along with other Police personnel reached near Darwaja of Shankar Prasad and saw one Passion Pro Motorcycle bearing registration No. BR21N-9364 standing. Co-accused Manish Kumar was found present there at that time. He was apprehended by the Police. On demand, he could not produce paper with regard to the aforesaid Motorcycle. He told that he has purchased the Motorcycle from Sonu Kumar. Thereafter, the informant reached the house of Sonu Kumar. He was apprehended. He disclosed that one Golu Kumar

Patna High Court CR. MISC. No.31433 of 2019(2) dt.10-05-2019 2/2 (petitioner) can disclose about the aforesaid Motorcycle. The Police recorded confessional statement of co-accused Sonu Kumar. It is alleged that police reached the house of petitioner, but he managed to run away. One Glamour Motorcycle bearing registration No. BR21D-8850 was recovered from his house.

Counsel for the petitioner submits that nobody was present in the house at the time of seizure.

Seizure list which is part of First Information Report does not bear signature of either petitioner or any of his family members.

Petitioner is in custody since 27.3.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Hilsa, Nalanda, in connection with Islampur P.S.
