Mr.Md. Khurshid Alam (Aag 12) ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-12-2023
1. The present review petition has been filed seeking the following relief(s):- "1. That the present application has been filed for the review of the order dated 21.05.2015, passed by Hon'ble Mr. Justice Samarendra Pratap Singh in CWJC No.11560 of 2008, by which the order dated 22.10.2008, passed by Sub-Divisional Officer, Madhubani in Land 1-4/73-74 2/2002-03 Ceiling Case No. , (as contained in Annexure-1 to the connected writ petition) has been set aside and the matter has been remitted back for fresh consideration before the authority concerned."
2. After some arguments, the learned counsel for the petitioners submits that since none of the grounds, as envisaged under Order 47 Rule 1 of the Code of Civil Procedure, 1908 exists so as to warrant review of the order of this Court dated 21.05.2015, nor any cogent or important evidence has been brought on record of the review petition nor there is any mistake apparent on the face of the record of the case, the review petitioners be granted liberty to take recourse to the appropriate remedy, available under the law.
Patna High Court C. REV. No.112 of 2016(7) dt.14-12-2023 3/3
3. Accordingly, the present review petition stands disposed off as not pressed, however, with liberty to the petitioners to avail such other alternative remedies, as are otherwise available under the law.
