The petitioner apprehends his arrest in Belhar P.S. Case No.37 of 2018 registered under Sections 366(A), 120(B), 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner has been rejected by a coordinate Bench of this Court vide order dated 17.07.2019 passed in Cr.Misc.No.25102 of 2019 (Annexure 1). Further, the fresh ground of learned counsel for the petitioner is that the victim in her statement recorded under Section 164 Cr.P.C. has stated that she has married with the son of the petitioner and after the wedlock, she gave birth to a female child as is evident from Annexure 3.

The petitioner has got no criminal antecedent.

No.39219 of 2021(2) dt.25-02-2022 2/2 Considering the above facts and circumstances of the case as well as Annexure 3, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate III, Banka in connection with Belhar P.S. Case No.37 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
