The petitioners apprehend their arrest in connection with Rajpur P.S. Case No.251 of 2017 registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code. The accusation is that on 27.09.2017, the informant Sunaina Devi was clearing the Cesspool (Naabdaan). At that time, both the petitioners alongwith Radhika Devi reached there and started to abuse the informant. When the informant made protest then Hare Ram Sah (petitioner no.1) caused injury at her waist and pelvis through lathi and Jai Ram Shah (petitioner no.2) caused cut
Patna High Court Cr.Misc. No.55314 of 2017 (2) dt.28-11-2017 2/3 injury below her right eye through spade. At that time, Radhika Devi caught hold of hair of the informant, dragged and assaulted her through fists and slaps.
Learned counsel for the petitioners submits that the petitioners and the informant are co-villagers and Pattidaars. Moreover, three injuries were found on the person of the informant, out of which injury nos.2 and 3 are simple in nature. So far as the nature of injury no.1, swelling and ecchymosis invoking whole of face, is concerned, the opinion regarding the same has been kept reserved, which is attributed to the petitioner no.2 Jai Ram Sahu alias Jai Ram Shah.
Having considered the facts and the circumstances of the case, let the petitioner no.1, namely, Hare Ram Sahu alias Hare Ram Sah, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Rajpur P.S. Case No.251 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. So far as the petitioner no.2, namely, Jai Ram Sahu alias Jai Ram Shah, is concerned, considering the nature of allegation against him, I am not inclined to grant him anticipatory bail.
Patna High Court Cr.Misc. No.55314 of 2017 (2) dt.28-11-2017 3/3 Accordingly, the prayer of the petitioner no.2, namely, Jai Ram Sahu alias Jai Ram Shah, for grant of anticipatory bail stands rejected.
