====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-07-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

3. It is a case of dowry death. Informant's daughter was married to the petitioner in 2021 and out of the wedlock they had a female child. Later on, petitioner and his family members started subjecting the victim to cruelty and harassment and killed her by pressing neck for non-fulfilment of demand of dowry.

4. Learned counsel appearing for the petitioner submits that the petitioner is husband of the deceased. She was a lady of short temperament and due to some family dispute she committed suicide by hanging. Information of death had also been communicated to her parents and they had also participated in the funeral and later on due to oblique motive, informant lodged this false and concocted case. Post mortem report reveals that there was no external or internal injury on the body of the deceased. Petitioner is in custody since 12.12.2023.

Patna High Court CR. MISC. No.33200 of 2024(4) dt.19-07-2024 2/2

5. Learned counsel for the State opposes the prayer for bail. He submits that petitioner is the husband of the deceased and there is direct and specific allegation that he and his family members killed the deceased for non-fulfilment of dowry demand.

6. Considering the fact that the petitioner is husband of the deceased, who died in unnatural condition within seven years of marriage in her in-laws house, prayer for bail of the petitioner is rejected.
