2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 366A and 34 of the Indian Penal Code.
3. As per the F.I.R., co-accused Azad Ansari along with the help of this petitioner kidnapped the daughter of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that specific accusation of kidnapping the daughter of informant is against co-accused Azad Ansari. The victim in her statement recorded under Section 164 Cr. P.C had denied the prosecution case and stated that she went along with co-accused Azad
Patna High Court CR. MISC. No.33923 of 2024(2) dt.22-05-2024 2/2 Ansari and nobody kidnapped her. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the statement of the victim recorded under Section 164 Cr. P. C , clean antecedent of the petitioner and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM at Chapra , Saran in connection with Baniyapur P.S. case No. 334 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
