13-01-2017 Heard Sri Mritunjay Prasad Singh, learned counsel for petitioners and learned A.C. to Govt. Advocate - 2. The present petition has been filed with a prayer to restore C.W.J.C. No. 9109 of 2012, which stood dismissed on 28-02-2013, due to non-prosecution.

Sri Mritunjay Prasad Singh, learned counsel for petitioners submits that due to serious ailment, the Advocate-onrecord failed to appear on 28-02-2013 and writ petition stood dismissed due to non-prosecution. Sri Singh submits that even after filing of the present restoration petition, subsequently the learned counsel, who had filed earlier vakalatnama on behalf of petitioners, left for heavenly abode.

In view of facts & circumstances, the restoration petition stands allowed.

Patna High Court MJC No.3494 of 2013 (3) dt.13-01-2017 2/2 Let C.W.J.C. No. 9109 of 2012 be restored to its original file.
